      FRANKLIN ALLEN’S DUPLICITY BROUGHT TO LIGHT

      HUSBAND OF OVID WOMAN DESERTED HER AFTER THE WAR.

      Widow Now Seeks to Recover Dower Interest in Property at Batavia, New York

      The double life led by Franklin Allen, who left his wife at Ovid way back in the sixties to go to war and who failed to report after peace has been declared, is brought out by an action recently started by Mrs. Theresa J. Allen of Ovid in the courts of Batavia, New York, against parties there who have purchased lands in which Mrs. Allen claims a dower interest.

      The story connected with the case is an interesting one. Franklin Allen, a veteran of the Civil war, who drew a pension of $75 a month on account of total disability, moved to Batavia from Rochester about seven years ago. He was accompanied by a woman whom he said was his wife and who bore the name of Augusta H. Allen. The latter bought the Pearl street property now involved in the litigation in her own name. On September 14, 1893, she deeded the west half of the property, which was then vacant, to Franklin Allen. The latter soon deeded it to a Fannie R. Rice of Rochester, who transferred it back to Augusta H. Allen. In 1900, Augusta H. Allen sold the whole property to Milo B. Langworthy and the Allens moved back to Rochester, where Franklin Allen died in April, 1901.

      In her complaint in the suit just brought Theresa J. Allen alleges that she and not Augusta H. Allen was the lawful wife of Franklin Allen. She asserts that she was married to him on September 14, 1857, at Gananoque, Ontario and that they lived there five years, moving then to Fulton, New York, where they spent five years more. Then they come to Michigan, where Allen deserted here at the breaking out of the war. She claims that he never obtained a divorce from her and that she is therefore entitled to her dower interest in the west half of the Pearl Street property, to which Allen had title for a short time and which he deeded away without her consent.

      It is said that Mrs. Allen first discovered the true condition of affairs when she applied to the Pension Department at Washington for a widow’s pension and was informed that Franklin Allen was on the roll drawing $75 per month. By a ruling of the department Mrs. Allen was entitled to one-half this amount and she continued to draw it up to the time of Mr. Allen’s death and has received the widow’s pension since that time.

      Another Woman, Who Lived With Him as His Wife in Batavia, Resides in Rochester -- The Former Sues to Recover Her Dower in Batavia Property.

      Mrs. Theresa J. Allen of Ovid, Michigan, has begun a Supreme court action against Mr. and Mrs. A. P. Savacool, Mr. and Mrs. C. J. Norton and Mr. and Mrs. W. D. Palmer, all of Batavia, and the Genesee County Loan Association to recover her dower interest in property located on Pearl street in Batavia, said to be worth $3,600.

      M. B. Langworthy, who bought the property from Augusta H. Allen, sold the west half, except a little notch of land, to Albert P. Savacool, and the east halff, on which the Allen house is located, and the notch from the west half to William D. Palmer. Mr. Savacool built two houses on his half and sold one of them to C. J. Norton. That is why these persons are made parties to the action.
      If Theresa J. Allen proves her allegations she will be etitled only to a third interest in the west half as it was before any houses were built on it. The present owners apparently are relieved from any responsibility in the matter, however, as M. B. Langworthy gave them warranty deeds of the property. W. C. Watson is Theresa J. Allen's attorney.
